Each quarter, KC&S attorneys provide commentary on BSEA decisions and rulings.  Available now are the commentaries for the first quarter of 2019 (January – March), written by Melanie Jarboe, and the second quarter of 2019 (April – June), written by Alicia Warren.

The first quarter’s materials concerned disputes regarding placements and the placement process, independent educational evaluations (“IEEs”), joinder of state agencies and other districts, disputes involving program schools (school choice and METCO), motions for recusal of the hearing officer, and parental access to student records.

In the second quarter, the hearing officers tackled topics such as the appropriateness of proposed placements, a determination of financial and programmatic responsibility between two school districts, joinder of state agencies, preclusion, hearing officer recusal, IEEs, and field trip chaperones.
